Jobs in Oxfordshire Terms & Conditions

Please read this agreement carefully. It sets out the terms under which Jobs in Network Ltd offers you use of its services as defined in clause 1.1 of this agreement by means of Jobs in Oxfordshire or JobsinOxfordshire.co.uk (the "website"). By using any of the services and/or the website you agree that you have read and accept these terms and conditions and that they shall apply to your use. If you do not wish to be bound by them, please do not register for or use this website.

This Agreement is made between you and Jobs in Network Ltd.  Registered office:  Jennings Business Centre, 1-5 London Place, St Clements, Oxford OX4 1BD. Company number: 7573931.


1.The Services


1.1.By means of the Website, Jobs in Oxfordshire makes available an on-line recruitment and employment information service, where recruiters and employers place advertisements for positions which they have and if interested you may submit responses to such positions (the "Services").


1.2.Please note that when responding to recruiters or employers you will be dealing with them directly and as such any contracts and/or arrangements will be formed between you and them, without Jobs in Oxfordshire as a party and Jobs in Oxfordshire cannot be held liable for your use of or any liability arising out of the same (save to the extent required by law).


1.3. The Services are available on the completion of the registration section of the Website including confirmation that the relevant terms and conditions have been read and accepted. If you do not register on the website and use the ‘apply now’ button you are still bound by the terms of use of the website.


2.Use of the Website and the Services


2.1.All copyright, database rights and other intellectual property rights in the site and the material available on the site belongs to Jobs In Network Ltd or its third party suppliers. Use of the site does not give you any proprietary rights in such materials.


3.Employment Agencies and Employment Business Regulations 2003


3.1.Jobseekers, employers and recruiters need to be aware that this job board operates as a venue only and does not introduce or supply work-seekers to recruiters (or vice versa). This means that we do not:


3.1.1.obtain sufficient information for potential recruiters to select a suitable work-seeker for the position which the recruiter seeks to fill;

3.1.2.obtain confirmation of the identity of a work-seeker or that they have the experience, training, qualifications or authorisation to work in the position to be filled or that they wish to undertake the role to be filled;

3.1.3.take any steps to ensure the work-seeker and recruiter are each aware of any requirement imposed by law or otherwise which must be satisfied by either of them to permit the work-seeker to fulfil the position to be filled;

3.1.4.take any steps to ensure that it would not be detrimental to the interests of the work-seeker or the recruiter for the work-seeker to fulfil the position to be fulfilled;

3.1.5.give any indication to recruiters whether work-seekers are unsuitable (or suitable) for any position to be filled in any circumstances;

3.1.6.propose work-seekers to recruiters or provide any information about them;

3.1.7.take up any references in relation to a work-seeker; or

3.1.8.make any arrangements for accommodation of work-seekers.


3.2.The Conduct of Employment Agencies and Employment Business Regulations 2003 (the "Regulations") seek to ensure that job seekers are only proposed by employment agencies for roles for which they are properly qualified and that recruiters are only offered job seekers who have the appropriate levels of experience, training, qualifications and authorisation for the position to be filled. Since we are only a venue and do not propose or introduce job seekers to recruiters or vice versa, it is recommended that, if you are a job seeker you undertake the steps set out in the Regulations to ensure your suitability for the role advertised or, if you are a recruiter, to ensure a job seekers suitability for the role.


3.3.These could include:


3.3.1.If you are a job seeker; checking the identity of the recruiter and the nature of its business, the commencement date and duration of the position, the position to be filled including type of work, location, hours and risks to health and safety, experience, training, qualifications and authorisation which the recruiter considers necessary or are required by law or otherwise to undertake the position, whether any expenses are payable by you as a work-seeker or whether there are any requirements imposed by law or otherwise for you to satisfy before taking up a position.

3.3.2.If you are a recruiter or employer; checking the identity of the job seeker and that the job seeker has the experience, training, qualifications and authorisation required by law or otherwise for the position and whether there are any requirements imposed by law or otherwise for you, as the recruiter, to meet to enable a job seeker to take up a position.

3.3.3.In addition, where professional qualifications are required or where job seekers are to work with vulnerable persons or children, you should obtain copies of the relevant qualifications or authorisation, obtain at least two references from people who are not relatives of the work-seeker and undertake a criminal records bureau check of the job seeker. Any searching or screening tools provided by us for use in your assessment of the suitability or otherwise of any particular candidate or advertised vacancy are to assist you in taking these steps, but are not intended as a substitute.


4.Job Seekers

4.1.You agree that you shall not use the Website or the Services to transmit or knowingly or recklessly receive (or knowingly or recklessly authorise or permit any other person to receive or transmit) material which is obscene, threatening, menacing, offensive, defamatory, abusive, untrue, in breach of confidence, in breach of any intellectual property right (including copyright) or which may cause anxiety to others including racist or sexist content or material which otherwise violates any applicable law or regulation or code, or which makes excessive demands for bandwidth or contains any virus or which may otherwise impair or harm Jobs in Oxfordshire’s computer systems or any third party computer system.


4.2.By registering to use the Services pursuant to clause 1.3, you automatically and hereby grant to Jobs in Network Ltd a royalty free right to display, copy, reproduce and make available on the Website and otherwise deal with as necessary to provide to you the Services any material and information which you may provide to Jobs in Network Ltd through your use of the Services.


4.3.Save to the extent required by law, no representations, warranties or terms of any kind are made in respect of the Website and/or the Services or their contents (including, without limitation, any views or comment made).


4.4.All information and/or data included in and/or on the Website, the Services and/or in any directory or other listings or information retrieval service made available on or by the Website and/or the Services has been so made available for guidance only. Your use of such information and/or data is therefore entirely at your own risk.


4.5.All liability of Jobs in Oxfordshire, its directors, employees or other representatives howsoever arising for any loss suffered as a result of your use of the Website and/or the Services is expressly excluded to the fullest extent permitted by law.


4.6.Jobs in Oxfordshire make no warranty that the contents of any and all e-mails communicated through the Site are free from infection by viruses or anything else which has contaminating or destructive properties and shall have no liability in respect thereof.


4.7.The Website and/or the Services may include links to websites and/or services owned and/or operated by third parties. These are provided for your convenience only and Jobs in Oxfordshire is not responsible for and does not give any warranties or make any representations regarding any such websites and/or services and is not responsible for or liable in relation to the content or your use of such websites (save to the extent required by law).


4.8.You acknowledge that Jobs in Oxfordshire is not responsible for third party content on the Website and that Jobs in Oxfordshire cannot ensure that material presented on the Internet is legal. Jobs in Oxfordshire will not limit access to material unless notified that it is illegal. In particular, you acknowledge that Jobs in Oxfordshire is not responsible for and does not monitor the content of job postings provided by third parties on the Website. However, Jobs in Oxfordshire shall have the right to remove any postings, materials or other items on the Website which it believes may be illegal or which it determines to be inappropriate.


4.9.Jobs in Oxfordshire will not be a party to any communications whatsoever between you and those responding to any use which you may make of the Services, although Jobs in Oxfordshire reserves the right to monitor any such communications which are made by you or third parties by means of the Website and/or the Services.


4.10.Jobs in Oxfordshire may terminate, suspend or deny you access to the Website and/or Services immediately for any reason without incurring any liability whatsoever to you.


5.       Availability of the Website and the Service


5.1.    Jobs in Oxfordshire does not promise full, uninterrupted or error free operation of the Website and/or the Services.


5.2.    All liability of Jobs in Oxfordshire, its directors or employees howsoever arising for any loss whatsoever arising from your use of or inability to use the Website and/or the Services is excluded, insofar as it is possible to do so in law.


6.       Intellectual Property


6.1.    Save to the extent permitted by this Agreement, Jobs in Oxfordshire does not grant any licence or other authorisation to use any of its trade marks, product names, company names or logos or any of its copyright works or other intellectual property rights by placing them on or making them available by means of the Website or the Services.


7.       Registration


7.1.    Where you are asked to complete a registration form the personal or company details that you provide must be true, accurate and complete. You agree to notify us of any changes which are relevant to your registration.


8.       Data Protection and Use of Personal Information


8.1.    Your personal data will be collected and processed by Jobs in Oxfordshire in accordance with our privacy policy. The personal data collected may include, without limitation, your name, address, telephone and fax details, email contact address, and other data obtained from you from time to time.


9.       Claims


9.1.    You agree to indemnify Jobs in Oxfordshire and all websites in the Jobs in Network Ltd group for all losses, costs, actions, claims, damages, expenses (including reasonable legal costs and expenses) or liabilities, whatsoever suffered or incurred by Jobs in Oxfordshire or Jobs in Network Ltd or as a consequence of your breach of this Agreement and/or your use of the Website and/or Services (save to the extent that a court of competent jurisdiction holds that such a claim arose due to an act or omission of Jobs in Oxfordshire).


10.   Force Majeure


10.1.Neither party shall be liable, for any loss or damage which may be suffered by the other party, or failure or delay in performing their obligation under these Terms and Conditions, due to any cause beyond the first party's reasonable control. Such causes include but are not limited to: power failure, Internet Service Provider failure, industrial action, civil unrest, fire, flood, storms, earthquakes, acts of terrorism, and acts of war, governmental action or any other event that is beyond the control our control.


11.   Notices


11.1.Any notices shall, unless otherwise expressly stated, be in writing and shall be given by sending the same by e-mail, first class post, or facsimile transmission to the other party's address as may be designated in writing from time to time.


11.2.Any notice sent by first class post shall be deemed (in the absence of evidence of early receipt) to have been delivered two days after dispatch.


11.3.Any notice given by e-mail or facsimile transmission shall be deemed to have been delivered on the next working day following transmission.


12.   Assignment


12.1.This Agreement shall be personal to you and you may not assign, transfer, sublet, lease or delegate all or any of your rights and obligations, without Jobs in Oxfordshire's prior written consent.


12.2.Jobs in Oxfordshire reserves the right to assign or transfer all or any of its rights and obligations under this Agreement to Jobs in Network Ltd or any other third party. In the event of assignment or transfer, notification will either be given to you by e-mail or posted on the Website.


13.   No Waiver


13.1.Failure or neglect by either party to exercise or enforce any right conferred shall not be deemed to be a waiver of any such right nor operate so as to bar that exercise or enforcement thereof or of any other right on any later occasion.


14.   Severability


14.1.If any provision of this Agreement or part thereof is determined to be invalid, unlawful or unenforceable, such provision, or part thereof, shall be severed from the remaining terms, conditions and provisions which shall continue to be valid and enforceable to the fullest extent permitted by law.


15.   Variation of Terms


15.1.This Agreement (together with any variations to it pursuant to clause 12.2) constitutes the entire agreement between the parties in respect of its subject matter.


15.2.Jobs in Oxfordshire reserve the right to vary this Agreement from time to time.


15.2.1.    Such changes shall either be notified to you by e-mail or posted on the Website.

15.2.2.    Changes in this manner shall be deemed to have been accepted if you continue to use the Website and/or the Services after a period of two weeks from the date of transmission of the e-mail or of posting on the home pages of the Website, whichever occurs later.


Terms and Conditions for Employers & Recruiters

In these terms and conditions:

'Customer'                                 means any person, company, organisation or firm which purchases Services from us;

'Order Form'                              means an order for Services on a form provided by us (in any format) and signed by a Customer;

'Services'                                    means all recruitment products and services made available by us from time to time;

'Contract Month'                     means, in respect of any Order Form relating to the provision of Services for a specified period of months, the calendar month commencing on the start date specified in the Order Form and ending on the day before the same date in the next calendar month. For example, the calendar month commencing on 24 February and ending 23 March;

'Contract Term'                        means the full term specified in the Order Form.


1.       Commencement of Services


1.1.    We will not commence the provision of Services pursuant to any , in a form approved by us and confirmed by the Customer by way of signature, e-mail confirmation or provision of purchase order number and, in the case of Customers who purchase Services on terms that require pre-payment, Services will not commence until payment is received and cleared.




2.1.Prices are as specified in the Jobs in Oxfordshire rate cards and are guaranteed for the period stated on the Order Form.


2.2.Any discounts agreed are confidential and may not be disclosed by the employer or recruitment agency.


2.3.A job posted on Jobs in Oxfordshire will remain live for 30 days or such shorter time as we agree with the employer or recruiter.


2.3.1.Any extension of this time will be charged to the Customer as a new posting unless agreed in writing differently.

2.3.2.Any jobs posted in addition to the agreed number of jobs per month will be charged at a price per job agreed with the customer at the time of the contract negotiation.

2.3.3.If no price has been negotiated, a flat fee of £350 per job will be charged for each job over the agreed number.

2.3.4.A single job is identified by its unique ID number. If a customer deletes a job and then either reposts it or posts another, this will be classed as two jobs.

2.4.If any Services to be used within any time period specified on the Order Form are not used within that period of time they may not be carried over into any subsequent period without our prior written consent. The Customer will be responsible for payment for any unused Services.




3.1.All prices exclude VAT. All invoices are payable within 28 days from invoice date. Late payment will entitle us to suspend provision of Services. Interest will be payable on late payments at the rate of 3% above HSBC’s base rate from time to time.




4.1.The employer or recruiter may terminate in writing the provision of Services under any Order Form by no less than:

4.1.1.To expire at the end of the contract Month.

4.1.2.We are in material breach of these terms and conditions and have not remedied such breach within ten days of notice specifying the breach and requiring that it be remedied, or:

4.1.3.We become insolvent, cease to trade or go into liquidation

4.1.4.Termination by the Customer before the end of the Contract Term may, at our discretion, result in loss of discounts agreed for the entire Contract Term.


4.2.We may terminate the provision of Services if:


4.2.1.The Customer is in material breach of these terms and conditions and has not remedied such breach within ten days of notice specifying the breach and requiring that it be remedied, or:

4.2.2.The Customer becomes insolvent, ceases to trade or goes into liquidation.


5.       Limitation of liability


5.1.    Our total liability to the Customer in respect of any Services, except for death or personal injury caused by our negligence, is limited to the total amount paid to us during the Contract Term for such Services or £10,000, whichever is the greater.


6.       Job advertising


6.1.    Job adverts go live after payment confirmation on Jobs in Oxfordshire during the following times based on 24 hour clock UK time;

6.2.You will be notified by email when your job adverts have gone live on Jobs in Oxfordshire.


7.Site rules


7.1.We have rules regarding the content and format of jobs posted on Jobs in Oxfordshire.


7.2.Their purpose is to ensure that users who search the site or the Jobs in Oxfordshire database get results which are presented as clearly and informatively as possible.


7.3.You agree that we may, at our discretion and without liability to you, remove from Jobs in Oxfordshire any advertisement which is posted in breach of these rules.


7.4.The rules may change from time to time and you are advised to refer to them regularly.


7.5.The Rules are:


7.5.1.No duplicating of jobs at the expense of other clients' jobs.

7.5.2.No gratuitous use of keywords in job descriptions or job titles. Gratuitous means deliberately inserting words, strings of words, or repeating job titles, with the intention of influencing position in the results listing, or increasing the number of page views.

7.5.3.Job advertisements placed on Jobs in Oxfordshire must be for genuine vacancies only, and not for other products or services, either relating to or unrelated to recruitment including, but not limited to, affiliate schemes, pyramid selling schemes or any other so called 'business opportunity'.

7.5.4.URLs or email links (live or text only) are not permitted in the body copy of the job description page. Email links are permitted from the 'send an email' link and url linking is permitted from the 'apply online' link.


8.Illegal Advertisements


8.1.Advertisements which appear to discriminate on grounds of sex, race or disability are illegal and may result in proceedings being taken against both the advertiser and the publisher.


8.2.Advertisements are accepted by Jobs in Oxfordshire on the basis that the advertiser confirms that any requirement or qualification which may appear to discriminate illegally is in compliance with any exemption available under the relevant legislation.


8.2.1.Notwithstanding this confirmation, if we nonetheless believe that an advertisement may be discriminatory we may at our discretion either amend the advertisement or remove it from Jobs in Oxfordshire without liability to you to make any refund of amounts paid or due to be paid in respect of the posting or otherwise and will inform you accordingly.


9.Responses to advertisements


9.1.You agree to deal fairly and professionally with individuals who may respond to an advertisement you have posted and not do anything which may bring jobs in into disrepute.


9.2.You will indemnify us from and against any claim brought by an individual against JobsinOxfordshire.co.uk arising from your breach of this obligation or any other of these terms and conditions.


9.3.We do not guarantee any response to your advertisement or that responses will be from individuals suitable for the job advertised.


9.4.It is your responsibility to carry out such checks and procedures as are necessary to ensure that candidates are suitable for the job advertised and have the required qualifications and personal characteristics.




10.1.It is your responsibility to ensure that you have the appropriate equipment and are connected to the appropriate services to enable you to post jobs to Jobs in Oxfordshire.


11.Content and links


11.1.If your advertisement links to another site via our external apply online option, you are responsible for maintaining the links and for the content of your advertisement and the linked site.


11.2.We may remove from Jobs in Oxfordshire any advertisement which contains content or links to a site which, in our opinion, is defamatory, illegal or objectionable or will bring Jobs in Oxfordshire into disrepute.


11.3.You will indemnify us from and against any claims or liability arising from content or links contained in your advertisements.


12.Third party sites


12.1.Vacancies you post on Jobs in Oxfordshire may also appear on third party recruitment web sites pursuant to agreements from time to time between Jobs in Oxfordshire and the proprietors of such web sites.


13.Customer supplied content


13.1.These terms and conditions apply to all advertising campaigns ('Campaigns') and other material accepted by Jobs in Oxfordshire for display on any of our web sites.


13.1.1.By placing any such material you accept these terms and conditions as principal, even if you are acting as agent or buyer for the third party advertiser.


13.2.We must receive the complete creative content for a Campaign in acceptable format at least two working days before 9 am on the go-live date specified in your order. Otherwise, we may not be able to achieve the specified go-live date but you must pay the full amount set out in the order irrespective of whether any delivery target for impressions have been met.


13.3.To cancel or alter an order for a Campaign you must inform us, by fax or email at the number or address on the order, at least two working days before 9 am on the go-live date specified in your order. Otherwise you must pay the full amount set out in the order, irrespective of whether any delivery targets for impressions have been met.


13.4.You are responsible for the content of material supplied by you and for ensuring that you have the right to supply it to us and that it complies with all relevant legislation and codes of practice.


13.4.1.If we receive complaints about any material or its content we may, at our discretion, remove the material from display without reference or liability to you. You will indemnify us against any claim that the material infringes the intellectual property rights or other rights of others or is defamatory or otherwise offensive.


13.5.If you are an employment agency or an employment business (as defined by the Employment Agencies Act 1973) it is your responsibility to ensure the advertisements you place on Jobs in Oxfordshire comply with the Conduct of Employment Agencies and Employment Businesses Regulations 2003.


13.6.You are also responsible for fulfilling and dealing with any orders or enquiries relating to the goods or services to which a Campaign relates and you will indemnify and hold us harmless accordingly.


13.7.Your sole remedy if we, or our third party subcontractors who may host and serve Campaigns from time to time, make an error in displaying any Campaign is the cost of re-running the relevant Campaign.


13.7.1.Neither we nor our subcontractors shall be liable in any circumstances for any loss of profit or business. We shall, additionally, have no liability for failure to display the Campaign caused by circumstances outside our control.
